Big ferry ship vs small boat on a lake

The ferry passengers noticed a smaller boat approaching them, and there was no sign of wanting to stop the ferry. The incident took place in the US state of Washington. According to the rules, the boat is preferred by the boat on the right hand side. However, this would only apply if it were a motor boat of the same size. In this case, a ship with a worse maneuverability was preferred.
